الحقوق العينية التبعية التي ترد على السفينة "دراسة تطبيقيه علي حقي الرهن والامتياز

Abstract

تناول البحث موضوع الحقوق العينية التبعية التي ترد علي السفينة وهي دراسة تحليلية مقارنة وهدف البحث تتبع الديون الممتازة السفينه في اي يد كانت و تتبع الرهن البحري للسفينة وتمثلت مشكلة البحث في ان السفينة مال يجوز تنفيذ الدين عليه ولكن هل يجوز ان ينتقل هذا الدين عند بيعها؟ واتبع الباحث المنهج الوصفي التحليلي المقارن. وكانت اهم نتائجها : _ ان السفينة هي كل منشأة تكون معدة للعمل في الملاحة البحرية ولو لم تهدف إلى الربح تعتبر السفينة مالا منقولا إذ أنها يجوز أن تكون محلا للحقوق المالية . _ كما يقصد بالحقوق العينية التبعية مايقرره القانون من ضمانات للدائن على عين معينة(السفينة) تخوله إستيفاء حقه من ثمن هذه العين بما تخوله هذه الحقوق من أولوية للدائن الذي يتقرر له هذا الضمان. وكانت اهم توصياتها: _ علي الدائنين البحريين الاسراع في المطالبة بديونهم منعا من تراكم الحقوق الممتازة ورعاية لمصالح المرتهنين. _ يجب ان يبقي حق الدائن المرتهن علي ثمن الحطام كنوع من الحلول العينية.

Abstract The research dealt with the issue of the in-kind dependency rights that are received on the ship which is a comparative analytical study. The aim of the research is to track the excellent debt of the ship in any hand and to follow the maritime mortgage of the ship. The researcher followed the descriptive analytical comparative approach. The most important results were: _ The ship is any facility that is prepared to work in maritime navigation, and if not for profit, the ship is considered movable money as it may be subject to financial rights. _ In addition, rights in kind depend on what the law guarantees the creditor to a certain eye (ship) entitles him to fulfill his right of the price of this eye by giving them the priority of these rights to the creditor to whom this security is determined. Its main recommendations were: _ Maritime creditors should expedite the demand for their debts to prevent accumulation of excellent rights and care for the interests of the mortgagee. _ The right of the mortgagee should keep the price of the debris as a kind of in-kind solution.
